The defence argues that the jury’s verdict of $80,000 per infringed work is unconstitutional because it violates Due Process and, as a result, the judge should reduce the damages award to a more reasonable figure. Alternatively, Thomas-Rasset wants this verdict to be set aside and for yet another jury to be selected for a third trial. ” For 24 songs, available for $1.29 on iTunes, the jury assessed statutory damages of $80,000 per song - a ratio of 1:62,015.

2K Games is opening up a very dangerous door, apparently, as a source close to Joystiq has passed along info on the company’s new game for PSN and XBLA, called NBA 2K10: Draft Combine . Set to release alongside NBA 2K10 , the spinoff game will allow players to take potential draftees through a rigorous training routine, boosting their stats before being drafted into the retail game. We call it a “dangerous door,” because, frankly, it is. Many criticize sports titles for offering little variety or improvements in each yearly iteration, and Draft Combine sounds like it could be a way to milk sports fans for even more dough. Of course, not knowing further details about the rumored game, this is just speculation, and should be taken as such. Still, if it turns out as our worst fears predict (that Draft Combine is a minigame-like feature split from NBA 2K10 and sold separately), then we’re sure there are bound to be some upset gamers out there. There’s been a lot of news about the stalled negotiations between online radio providers, artists and record labels, but that seems to have come to an end, and at least one online music site is very happy about it. Pandora , a popular music player and recommendation service, was at the top of the list of possible casualties in the royalty battle, but thanks to the new agreement - which requires Pandora to pay out 25% of its U.S. revenue to SoundExchange in exchange for a whopping 40-50% reduction in royalty rates. According to the company, this means a fighting change to turn a profit in the near future. The effect on listeners is going to be fairly small. If you listen to over 40 hours a month of Pandora, there’ll be a 99 cent charge that buys you unlimited listening for the month.If you’re a Pandora One subscriber, you still get unlimited listening with no new charges. This agreement is in place until 2015. Other “pure play” music services like Pandora will be operating under the same deal, but there are carve-outs for small webcasters.
